We live a mobile society. It may be surprising to learn how difficult it can be for a person to move with a child to a new part of Virginia, or to a new state or country. This is particularly true when more than one party shares physical and legal custody of a child. A parent wishing to move with a child must generally first obtain court approval, particularly if custody and visitation have already been determined by a court order. The court will grant the relocation only if it finds the relocation is in the child’s best interest. The court will be influenced by facts such as the children’s relationship with both parents, the child’s stability in Virginia, and the economic factors present. The court will not give much weight to whether the relocation is in the best interest of the parent seeking to move. Each relocation situation is factually different and seeking legal advice prior to relocating with a child is prudent.
